Catholic Friends has the right to remove any user that it determines is not using the CF site as intended, who provides false or incomplete information, who is not eligible for sacramental marriage, or for any other reason that CF determines is what is best for the integrity of the CF service, and refuse all current or future use on Catholic Friends without refund of membership fees paid, no matter when the membership was established.

"Catholic Friends" is a licensed service mark. All rights reserved. 'Serious about their faith' and 'Seek a future spouse' are all service marks of Catholic Friends. All rights reserved. All other trademarks, product names, and company names and logos appearing on Catholic Friends are the property of their respective owners.

2. DISCLAIMERS AND LIMITATION OF LIABILITY   

User expressly agrees that use of Catholic Friends is at User's sole risk. Neither Catholic Friends, nor its affiliates, nor any of its officers, directors, or employees, agents, third-party content providers ("Providers"), merchants ("Merchants"), sponsors ("Sponsors"), licensers ("Licensers"), or the like, warrant that "Catholic Friends" will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of Catholic Friends, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through Catholic Friends.

"Catholic Friends" is provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose. No oral advice or written information given by Catholic Friends nor its affiliates, nor any of its officers, directors, employees, agents, Providers, Merchants, Sponsors, Licensers, or the like, shall create a warranty; nor shall User rely on any such information or advice.

Under no circumstances shall Catholic Friends or any other party involved in creating, producing, or distributing Catholic Friends be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use Catholic Friends, including but not limited to reliance by a User on any information obtained from Catholic Friends or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to Catholic Friends records, programs, or services. 3. CONTENT 

a. PROPRIETARY RIGHTS   

User acknowledges that Catholic Friends contains information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material (collectively "Content") that are protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. User acknowledges that Catholic Friends owns all email submitted to Catholic Friends by users, all success stories/testimonials, and all photos, and has the right to use this property for promotional, marketing and advertising purposes. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. If no specific restrictions are displayed, Users may make copies of select portions of the Content, provided that the copies are made only for User's personal use and that User maintains any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other propriety right. In addition to the foregoing, use of any software Content shall be governed by the software license agreement accompanying such software.

b. DISTRIBUTION/UPLOADING OF THIRD PARTY CONTENT   

User may upload to or otherwise distribute on Catholic Friends only Content that is not subject to any copyright or other proprietary rights protection (collectively, "Public Content"), or Content in which the author has given express authorization for distribution on the World Wide Web. Any copyrighted or other proprietary Content distributed with the consent of a copyright owner should contain a phrase such as "Copyright, owned by [name of owner]; used by permission." The unauthorized submission or distribution of copyrighted or other proprietary Content is illegal and could subject the User to criminal prosecution as well as personal liability for damages in a civil suit. User, Catholic Friends, nor its affiliates, nor any of its officers, directors, employees, agents, Merchants, Providers, Sponsors, Licensers, or the like, will be liable for any damage resulting from any infringement of copyrights or proprietary rights, or from any other harm arising from such submission.

By submitting Content to any User-submit areas, User automatically grants, or warrants that the owner of such Content has expressly granted Catholic Friends, the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, reproduce, publish, translate, sublicense, copy, and distribute the Content in whole or in part worldwide and/or to incorporate it in other works in any form, media, or technology now known or hereafter developed for the full term of any copyright that may exist in such Content. User also permits any other User to access, store, or reproduce the Content for that User's personal use. Subject to this grant, the owner of Content placed Catholic Friends, retains any and all rights which may exist in such Content.

c. THIRD PARTY CONTENT 

Catholic Friends is a distributor and not a publisher of Content supplied by third parties and Users. Catholic Friends has no more editorial control over such Content than does a public library or newsstand. Any opinions, advice, statements, services, offers, or other information that constitutes part of Content expressed or made available by third parties, including Providers, Merchants, Sponsors, Licensers, or any other User of Catholic Friends are those of the respective authors or distributors and not of Catholic Friends or its affiliates or any of its officers, directors, employees, or agents. Neither Catholic Friends, nor its affiliates, nor any of its officers, directors, employees, or agents, nor any third party, including any Provider, Merchant, Sponsor, Licenser, or any other User of Catholic Friends, guarantees the accuracy, completeness, or usefulness of any Content, nor its merchantability or fitness for any particular purpose.

In many instances, the Content available through Catholic Friends, represents the opinions and judgments of the respective Provider, Merchant, Sponsor, Licenser, or User not under contract with Catholic Friends, neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on Catholic Friends, by anyone other than authorized Catholic Friends, employees. Under no circumstances shall Catholic Friends, or its affiliates, or any of its officers, directors, employees, or agents be liable for any loss or damage caused by a User's reliance on information obtained through Catholic Friends. It is the responsibility of User to evaluate the information, opinion, advice, or other Content available through Catholic Friends.

Catholic Friends may elect to electronically monitor the User submit areas and may disclose any Content, records, or electronic communication of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate Catholic Friends or (iii) to protect the rights or property of Catholic Friends, its Users, Sponsors, Providers, Licensers, or Merchants. Catholic Friends is not responsible for screening, policing, editing, or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive Content, Catholic Friends may investigate the allegation and determine in its sole discretion whether to remove or request the removal of such Content from Catholic Friends. Catholic Friends reserves the right to prohibit conduct, communication, or Content that it deems in its sole discretion to be harmful to individual Users, Catholic Friends, the communities that make up Catholic Friends, or any rights of Catholic Friends, or any third party, or to violate any applicable law.

Notwithstanding the foregoing, neither Catholic Friends nor its Providers, Merchants, Sponsors, or Licensers can ensure prompt editing or removal of questionable Content after online posting. Accordingly, Catholic Friends, nor its affiliates, nor any of its officers, directors, employees, or Agents, nor Provider, Merchant, Sponsor, or Licenser shall assume liability for any action or inaction with respect to conduct, communication, or Content on Cathlolic Friends.

4. ONLINE CONDUCT 

Any conduct by a User that in Catholic Friend's sole discretion restricts or inhibits any other User from using or enjoying Catholic Friends, will not be permitted. User agrees to use Catholic Friends, only for lawful purposes and only for the purposes for which is designed and intended. User is prohibited from posting on or transmitting through Catholic Friends, any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

Catholic Friend's strictly and unconditionally prohibits the use of our service for any other purposes other than single Catholics making contact with other single Catholics in ways and for the purposes that represent acceptable communication that leads to seeking their potential future spouse. Any activity outside of this purpose will be considered a violation and abuse of the Catholic Friend's service and subject to immediate action by Catholic Friends™ to deactivate and/or remove the member from the Catholic Friends service.

No solicitation is permitted within the member center. Any members that use the messaging system of Catholic Friends to promote anything or solicit members to buy, sell, do, or use anything that is not directly related to Catholic Friends and/or without the express written consent of Catholic Friends will be immediately terminated from Catholic Friends without further notice and without the ability to reactivate their membership. Whatever time was left on their membership will be gone as well, with no refund, per our no refund policy. This decision will be solely Catholic Friends and used solely at the discretion of Catholic Friends.

5. PUBLIC AND PRIVATE COMMUNICATIONS  

Catholic Friends offers Users the capability to communicate with other members of the opposite sex in the Members Only areas accessible to registered Users. Catholic Friends will not screen public communication in advance. Catholic Friends is not responsible for submissions or responses during live events. Catholic Friends reserves the right to remove any Content that it deems in its sole discretion to be a violation of any law.

6. AGE AND RESPONSIBILITY

You represent and warrant that you are at least 18 years of age for use of this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You agree to be financially responsible for all of your use of this Web site (as well as for use of your account or log-in information by others, including without limitation minors living with you). You agree to allow Catholic Friends full access to all information provided by you for the purposes of Catholic Friends. You agree to supervise all usage by minors of this Web site under your name or account. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of products or services. You shall be completely responsible for all charges, fees, taxes, and assessments arising out of the use of this Web site.

7. USE OF THE MEMBER CENTER AND OTHER COMMUNICATIONS FORUMS 

If this Web site contains bulletin boards, chat rooms, or other message or communication facilities (collectively "Forums"), you agree to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, you agree that when using a Forum, you shall not do any of the following:

- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
- Publish, post, distribute, or disseminate any defamatory, infringing, obscene, pornographic, sexual, indecent, or unlawful material or information.

8. TERMINATION OF USAGE 

"Catholic Friends" may terminate User access, or suspend any User's access to all or part of Catholic Friends, without notice, for any conduct that Catholic Friends, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another User, a third-party Provider, a Merchant, a Sponsor, a Licenser, a service provider, or Catholic Friends.

9. MISCELLANEOUS

Users may not use Catholic Friends to send unsolicited advertising, promotional material, or other forms of solicitation to other Users, except in those specified areas that are designated for such a purpose.

10. INDEMNIFICATION   

You shall defend and indemnify Catholic Friends and its third party providers and distributors from and against any claim or cause of action brought by or on your behalf in excess of the liability described herein or by third parties as a result of your use of this Web site. 

11. RELATIONSHIP

The relationship among Catholic Friends, its third party providers and distributors and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other.

12. APPLICABLE LAW

This site is created and controlled by Catholic Friends in in the city of Port Elizabeth, South Africa.

13. ACKNOWLEDGMENT   

This Agreement represents the entire understanding between you and Catholic Friends regarding your relationship with Catholic Friends and supersedes any prior statements or representations. YOU AGREE TO BE BOUND BY THE COMMUNITY STANDARDS by using the Catholic Friends web site. The aforementioned Community Standards are subject to change.
